Transvaginal Mesh Implant Side Effects Lawsuit

Transvaginal Mesh Implant Side Effects Lawsuit

Transvaginal mesh implants, often used to treat Pelvic Organ Prolapse (POP) and Stress Urinary Incontinence (SUI), fail at an alarmingly-high rate causing painful and dangerous complications.  Many women with bladder mesh implants end up requiring an additional follow-up procedure or surgery.  If you are one of these women, compensation may be available for you!

To participate in this lawsuit you must meet the following requirements:

1) you must have had a revision surgery on your mesh implant
2) you must have had your surgery after 1999

The legal action against the makers of mesh implants is structured as a mass tort lawsuit (learn why that’s important to you). Unlike class action lawsuits, a mass tort lawsuit treats each claimant (victim) as an individual. What this means to you is that a separate, individual lawsuit against the manufacturer is filed upon your behalf. It is worth noting that settlements in these cases often result in large sums of money being awarded to the claimant; the majority going to you and a much lesser amount to the attorney. Also there is NEVER any upfront payment to the attorney or any out-of-pocket expenses for which you are responsible.

The Transvaginal Mesh Implant – Understanding the Risks and Consequences

For women, the vaginal mesh implant is a procedure where conditions like stress urinary incontinence and pelvic organ prolapsed are treated through installing a surgical mesh device. This device is also often referred to as a vaginal tape, patch or sling. There are a number of noticeable brands that manufacture and market these mesh implants and have been doing so for years.

However, in the recent years after a number of consequential incidents have been reported, the safety of these implants has been under question. So if you are thinking about getting a transvaginal mesh implant, here are some facts about the treatment which you should know before proceeding.

What These Implants Really Are

A transvaginal mesh is basically a piece of woven fabric that is inserted in the pelvic region for the purpose of providing support to the organs there. The fabric is shaped as a sling, holding each organ in its place so that they can stay fully functional. Usually, these mesh implants support the bladder, urethra, bowel, rectum and the upper areas of uterus and vagina.
As women age, especially after they go through menopause, the risk of POP and SUI increases. In other cases, the organs also slip down after procedures like a hysterectomy or child birth or due to muscle and tissue damage caused by age. This is the time when most women opt for these implants as a possible solution to get their organs working properly.

What Makes Mesh Implants Dangerous

In the recent years, more and more people have filed injury complaints with the FDA after going through a mesh implant surgery. Some of the common problems experienced by people in case of surgery failure are internal inflammation, mesh erosion, increased urinary problems, vaginal scarring and pain during sexual intercourse.

The rate of failure of these surgeries has gone up to almost 10%, where most of the problems are caused due to device failure. While the product was initially approved by the FDA in 1996, it was recalled from the market three years later due to the high number of complaints. Later, most manufacturers received approval for their mesh implants separately, but injuries continued happening.

Look Out For the Symptoms of Injury After Transvaginal Mesh Surgery

If you have had a satisfactory surgery, there is nothing you need to do except being thankful for your safety. However, as a necessary precaution, it is advised that you get annual checkups done to ensure that your mesh implant devices are in proper condition. This will keep complications from developing out-of-the-blue and escalating.

However, if your surgery has gone wrong in some way, the most common symptom you would notice is vaginal or pelvic pain. In some cases, this pain only occurs when you are having sexual intercourse. You should also look out for other symptoms, such as a return of the condition that was supposedly treated by the implants, constant bleeding and persistent discharge.

If you are experiencing any of these symptoms, you may be suffering surgery failure or device malfunctioning. In that case, you have the right to take legal action against the responsible authorities, You should do so the right away to ensure that you get compensated for your increased medical expenses and for all the trouble you are going through because of someone else’s negligence.
